3. Product Shipping
When physical products are required for production, clients are responsible for safely packaging and shipping those products to the address provided by Westlake Productions.
Unless otherwise agreed in writing, the client is responsible for the cost of shipping products to Westlake Productions.
Clients should provide shipment tracking information whenever available.
Westlake Productions is not responsible for products that are lost, stolen, delayed, or damaged before they are received by Westlake Productions.
We strongly recommend that clients use a trackable shipping service and obtain appropriate shipping insurance for products of significant value.
4. Product Condition and Use During Production
Clients should provide products in clean, functional, and photo-ready condition whenever possible.
Westlake Productions may handle, unpack, assemble, position, clean, stage, open, operate, or otherwise reasonably use products as necessary to produce the requested content.
Normal handling during photography or video production may result in minor wear to packaging or products.
Consumable, disposable, perishable, cosmetic, food, beverage, sealed, adhesive, single-use, or similar products may need to be opened or used during production and therefore may not be returned in their original condition.
Westlake Productions will make reasonable efforts to avoid unnecessary damage to client property.
If a production concept requires substantial or permanent modification of a product, we will attempt to obtain client approval before proceeding.
5. Product Storage and Returns
Unless otherwise agreed, Westlake Productions may retain client products for a reasonable period following completion of a project in case additional photography, revisions, or related production is required.
Clients who want products returned must notify Westlake Productions and provide or pay for appropriate return shipping.
Unless specifically included in a service agreement, return shipping costs are the responsibility of the client.
Westlake Productions may establish reasonable storage deadlines for completed projects. Products that remain unclaimed after notice has been provided to the client may be considered abandoned and may be discarded, donated, recycled, or otherwise disposed of at Westlake Productions' discretion, to the extent permitted by applicable law.
Clients should not send irreplaceable, exceptionally valuable, hazardous, illegal, or regulated products without obtaining written approval from Westlake Productions beforehand.
6. Creative Direction
By hiring Westlake Productions, the client acknowledges that creative services involve professional and artistic judgment.
Westlake Productions will make reasonable efforts to follow agreed creative direction, brand guidelines, references, and project objectives. However, reference images, mood boards, examples, and inspiration are intended to communicate general creative direction and do not guarantee an exact reproduction.
Differences in lighting, materials, environments, equipment, product characteristics, editing, composition, and other production variables are normal.
7. Artificial Intelligence and Digital Production
Westlake Productions may use artificial intelligence, generative imaging technology, compositing, digital retouching, image manipulation, background generation, object removal, image enhancement, and other digital production techniques as part of its creative workflow.
These technologies may be used to create or modify backgrounds, environments, props, visual effects, layouts, compositions, or other supporting elements.
Unless specifically agreed otherwise, the use of such tools is considered part of Westlake Productions' normal production and post-production process.
Westlake Productions will make reasonable efforts to ensure final deliverables meet our professional quality standards. However, clients are responsible for reviewing and approving final creative assets before publication, advertising, distribution, or commercial use.
8. Revisions
The number and scope of revisions included with a project will be specified in the applicable package, proposal, or service agreement.
A revision generally means a reasonable modification to an existing creative deliverable.
Requests that substantially change previously approved creative direction, require new photography, require a new set or concept, introduce new products, or otherwise materially expand the original scope may be considered additional work and may incur additional charges.
Additional revisions or production beyond the agreed scope will be quoted separately or billed at Westlake Productions' applicable rate.
9. Client Approval
Clients are responsible for reviewing all deliverables carefully before approving or publishing them.
Approval constitutes acceptance of the creative deliverable, including its design, composition, product appearance, copy, spelling, pricing, claims, disclaimers, and other visible content.
Westlake Productions is not responsible for errors that were present in materials supplied by the client or that remained in deliverables after the client provided final approval.
10. Advertising and Product Claims
Clients are solely responsible for ensuring that claims made about their products, services, pricing, promotions, warranties, performance, ingredients, specifications, certifications, or other commercial representations are accurate, lawful, and adequately substantiated.
Westlake Productions may create advertising materials based on information provided by the client but does not independently verify every product or marketing claim.
The client agrees not to instruct Westlake Productions to create content that is false, deceptive, unlawful, infringing, or otherwise misleading.
11. No Guarantee of Results
Westlake Productions provides creative and production services.
While our work is designed to improve the presentation, positioning, and marketing of our clients' products and brands, we do not guarantee any particular business outcome.

Marketing performance depends on numerous factors outside Westlake Productions' control.
12. Payments
Pricing and payment schedules will be stated in the applicable package, invoice, proposal, subscription, or service agreement.
Unless otherwise agreed, payments are due according to the payment schedule provided at the time of purchase or engagement.
Westlake Productions may require deposits, retainers, recurring payments, milestone payments, or payment in full before beginning or continuing work.
Production may be suspended if an account becomes overdue.
Final high-resolution or production-ready deliverables may be withheld until all amounts due for the applicable project have been paid.
13. Deposits and Retainers
Unless otherwise stated in writing, deposits and retainers reserve production capacity and may become non-refundable once production planning or work has begun.
If a client cancels a project after work has started, Westlake Productions may retain amounts reasonably attributable to work already performed, production time reserved, expenses incurred, or other commitments made for the project, subject to applicable law and the specific service agreement.
14. Cancellations and Rescheduling
Clients should notify Westlake Productions as soon as possible if a project needs to be cancelled, paused, or rescheduled.
Because production capacity is reserved in advance, cancellations or significant scheduling changes may be subject to fees specified in the applicable proposal or agreement.
Any third-party expenses, purchased materials, props, shipping costs, location fees, contractor expenses, or other non-refundable costs incurred specifically for the project remain the client's responsibility.
15. Intellectual Property
Unless otherwise specified in writing, Westlake Productions retains ownership of its underlying production methods, templates, processes, project files, working files, editing systems, designs, techniques, and other pre-existing intellectual property.
Upon full payment, clients receive the usage rights or ownership rights to final approved deliverables specified in their applicable service agreement.
Unless expressly included, delivery of final content does not automatically include RAW photographs, unedited video, layered design files, project files, source files, rejected concepts, unused images, or other working materials.
Such materials remain the property of Westlake Productions unless otherwise agreed in writing.
16. Portfolio and Promotional Use
Unless the client and Westlake Productions agree otherwise in writing, the client grants Westlake Productions permission to display completed, publicly released creative work for reasonable self-promotional purposes.
This may include:

Westlake Productions' website
-
Portfolio
-
Social media
-

-

Westlake Productions will make reasonable efforts not to publicly release confidential or embargoed campaign materials before the client's intended public launch.
Clients requiring confidentiality, white-label production, or restrictions on portfolio usage should notify Westlake Productions before production begins.
17. Client Materials and Intellectual Property
The client represents that it owns or has obtained the necessary rights to any trademarks, logos, photographs, videos, designs, copy, music, fonts, graphics, product packaging, or other materials supplied to Westlake Productions.
The client grants Westlake Productions permission to use those materials solely as reasonably necessary to perform the requested services.
The client is responsible for claims arising from materials supplied by the client that infringe or violate the intellectual property or other rights of a third party.
18. Third-Party Materials
Certain projects may involve licensed fonts, stock photography, stock video, music, software, templates, AI services, or other third-party resources.
Such materials may remain subject to the licensing terms of their respective providers.
Where applicable, the client's rights to those elements are limited by the corresponding third-party licenses.
19. Confidentiality
Westlake Productions will make reasonable efforts to protect confidential information provided by clients in connection with a project.
Clients should clearly identify information that is confidential, proprietary, embargoed, or subject to a non-disclosure requirement.
Unless otherwise agreed, ordinary creative discussions and materials that have already been publicly released are not considered confidential.
A separate Non-Disclosure Agreement may be executed when a project requires additional confidentiality protections.
20. Testimonials and Reviews
If Westlake Productions publishes a client testimonial or review in advertising or promotional materials, we may edit it for formatting, spelling, grammar, or length provided that such editing does not materially alter the client's meaning or experience.
Westlake Productions will not knowingly publish fabricated or materially misleading testimonials.
